Patents and copyright laws give the inventor the exclusive rights to the invention. No one else can produce the invention for a set period of time under patent and copyright law. Patents and copyright laws are set up to protect inventors. The law on patents can be found in the United States Constitution, Article 1, Section 8 and in Title 35 of the United States Code.

The agency in charge of patent laws is a Federal Agency known as the Patent and Trademark Office. Anyone who applies for a patent will have their application reviewed by an examiner. The examiner will decide if a patent should be granted to the inventor. Individuals who have their patent application turned down can appeal it to the Patents Office Board of Appeals.

You have three different categories you may purchase an article: usage, full, and unique. A copyright lawyer will explain exactly what each one means. Usage means the buyer gets to use the article one time, but the writer can use it again or resell it. Full rights will give the buyer all rights; they can even place their name on the article, saying they wrote it.

People usually look up to doctors and nurses because of the reputation they cultivated of alleviating the pain and suffering of their patients. We have heard so much of it from our parents, our teachers, and even our government, and as if these warnings were not enough even private institutions, and actually even those selling the same are stating that you must avoid driving under the influence of liquor. Well, as hard as a rock, the human mind has its way of doing just the opposite.

In almost all accidents on the road which are brought about by the negligence of another party, the proximate reason for the same is because such party was driving with a dazed mind because of alcohol. What makes the marriage between driving and drinking so attractive to people in our society? Well the answer is quite obvious, it is a status symbol, and much as they wouldn’t want to be a victim of an accident because of such carelessness, they would rather be caught drunk driving than be a boring square at parties or several gatherings.

GOVERNANCE OF THE DOMAIN NAMES SYSTEM AND DISPUTE RESOLUTION POLICIES

The objections of many to US control over the Internet and the functioning of the domain name system, led to the creation of the Internet Corporation for Assigned Names and Numbers (“ICANN”), a not-for-profit entity established by the United States government to remove the DNS from U.S. Governmental control for the benefit of all nations, and to take over many of the management functions of the DNS.

The United States Government, in its June 5, 1998 Statement of Policy on the Management of Internet Names and Addresses (the “White Paper”), called for the privatization of the DNS “in a manner that allows for the development of robust competition and that facilitates global participation in the management of Internet names and addresses.” The need for change in the DNS was seen to arise from 1) dissatisfaction with the absence of competition regarding domain name Registrars; 2) the increasing occurrence of conflicts between trademark and domain name owners, and the fact that the mechanisms for overcoming these were seen as expensive and cumbersome; 3) the call from commercial interests for more formal management of the Internet; 4) increasing desire from non-U.S. interests in participation in the management of various aspects of the Internet; 5) the need for accountability in the decision of whether to add new generic top-level domains (“gTLDs”); and 6) the inappropriateness of U.S. agencies managing and funding commercial enterprises on the Internet.

When a victim of domestic violence makes a call to the police, a number of things are likely to happen. The police will probably respond quickly and place the accused under arrest. An automatic protective order will be served and criminal charges are likely to be filed. The victim will be invited to move to a domestic violence shelter and can obtain immediate orders from the family court, awarding him or her full custody of the children and temporary child and spousal support. And, if a victim requests exclusive use of the home, his or her request will probably be granted.

Unfortunately, victims of domestic violence are often unaware of these and many other rights because it was not that long ago when our legal system’s attitude and method of dealing with domestic violence was radically different.

This past week, typically mindless commentary during a popular morning talk show caught my attention. All of a sudden amidst my morning routine, I heard words and phrases like “solution” and “cost-effective” and “best interests of the children” and… “divorce.” The host claimed there is a new phenomenon in which a married couple remains together, in almost every sense of the word, despite the fact that both desire a divorce. He referred to it as the “non-divorce” divorce. Supposedly, this trend is gaining popularity as the solution to a failed marriage.

The “non-divorce” divorce is a mutual verbal agreement between two married individuals who want to keep their marriage in tact, but fully accept that the relationship is over. The goal is to feel divorced while continuing to live together and not get a divorce. In other words, the couple does not want to go through the divorce process, but they don’t want to reconcile either. They don’t want to hire attorneys, file papers, argue over custody or support, lessen the time their children see either of them, or lose one-half of their financial assets. So, they decide to remain as if they are married. They live in the same family home as roommates, participate in their children’s lives as they had before they wanted a divorce, and maintain/preserve the marital estate.

Many people are interested in the Fair Use copyright law. The Fair Use copyright law enables people to use portions of material that is copyrighted for the purposes of criticism or as commentary. The hard part for many people is understanding what is permissible under the Fair Use copyright law and what is not permissible. Anyone who writes or publishes should brush up on what is allowed and what is not allowed. Using another person’s words to make news reports, to use as a comment or criticism or to use for research, scholarship, or for educational uses that are nonprofit are generally considered Fair Use. In these instances, the Fair Use copyright law allows one person or author to make use of another person or author’s work without asking permission to do so. In situations that do not fall within these specifications, you are probably violating someone’s copyright if you use their work – especially if you are using another person’s work for economic or commercial gain.
